Update to the Federal Travel Mask Mandate Case

By January 26, 2022March 31st, 2022No Comments

HFDF and several individual plaintiffs sued the Biden administration challenging the federal government’s mandate requiring that all passengers and staff don face masks on airplanes, in interstate travel, and at travel hubs.

In December, the court entered an amended scheduling order providing for a briefing schedule on the parties’ respective motions for summary judgment.

The government filed its motion on January 18, 2022.  Our response and cross-motion is due February 17, the government’s combined opposition and reply is due March 16, and our reply to that is due March 31.  A hearing is tentatively scheduled for May 13, 2022, although the court could decide to rule on the papers without a hearing.
