Employees Sue LAUSD for Mandating Experimental Covid-19 Vaccine

Last night employees of the Los Angeles Unified School District (LAUSD), with the assistance of the Health Freedom Defense Fund, filed a federal lawsuit demanding that LAUSD halt its Covid-19 vaccine mandate.  LAUSD, the second largest school district in the US, is forcing its employees to take an experimental vaccine in order to remain employed, which is contrary to federal law and basic human rights.

All Covid-19 vaccines available in the US at present have been issued under Emergency Use Authorizations (EUA) – none have been licensed or approved by FDA. In an emergency, federal law allows the issuance of medical products under an EUA but specifically defines any such products as “investigational” and requires that recipients be informed of the benefits, risks, and “the option to accept or refuse administration of the product.”

Vaccine development normally requires 8-10 years of research, development, and testing to demonstrate safety and efficacy before FDA approval and licensure, but Covid-19 vaccines have been rushed to market in a matter of months in what can only be described as a massive human experiment.

While the Johnson and Johnson Covid-19 vaccine is made using cells from aborted human babies, the Covid-19 vaccines manufactured by Pfizer and Moderna both employ a new technology that injects a genetic sequence, messenger RNA (mRNA), prompting the body to manufacture the spike protein believed to be on the surface of SarsCoV-2 in turn eliciting an antibody response in the body. No one knows the short, medium, or long-term effects of this medical intervention over 1, 5, 10, or 50 years.

Where will the spike proteins and responding antibodies migrate in the body? When will the production of spike proteins stop once they’ve begun? What organs or body systems will be impacted? Can any deleterious effects be undone? These questions can’t be answered as the studies have not been conducted.

Since implementation of the Nuremberg Code, free nations have recognized that forced medical experimentation of any kind is both inhumane and unethical. This human right against medical experimentation has been ratified by the 1964 Declaration of Helsinki and the US Code of Federal Regulations. In 2005, the General Conference of UNESCO adopted the Universal Declaration on Bioethics and Human Rights, requiring free and informed consent for participation in medical research-oriented treatments. There can be no doubt these treaties and regulations reaffirm the basic human right to bodily autonomy and the right to voluntary informed consent.

By choosing to mandate experimental Covid-19 vaccines, LAUSD is forcing employees to choose between providing for their families and being the victim of human experimentation. Forced vaccination is not only unethical, it violates the tenets fundamental to a free society and must stop.

      Please ensure that this fights for the students’ right to not take the vaccine, as well! CA has taken away all of our exemptions against forced vaccinations.

    I work at another school district in California and was hoping the LAUSD staff and parents would stand up to the vaccine mandate. I’m glad some staff are fighting against this. Hopefully there is a lawsuit coming soon from parents as well.

    I’m also in a CA school district. So far, no crazy “You are a direct threat and a danger” talk if you “refuse” this investigational product has come from our district, but, this is CA, home of the nanny staters and rights-usurpers. I do pray these plaintiffs win big. What has this nation come to with such paranoia??

    I’m a caregiver and was taken off an assignment because I refused the vax. My boss had pressuring me to get the vax saying she could lose the company if everyone didn’t comply. I’m sticking to my guns and hope you guys set a president with this case.

    Rutgers University is now requiring all incoming Fall students to be vaccinated. How can we stop this ?

        Are there any updates on the college mandates for Fall 2021? We are in California and the whole UC and CSU systems are requiring upon FDA approval. I am suspect of course that they know it will be approved which is why they put it as a stipulation for the mandate. I was hoping to join a group but they are hard to find. I obviously just found your site. Thank you for all your work!!!!!

          Lawsuits take a really long time and our team and affiliate colleagues are working on it, thank you all for the donations and support as we move forward in preparing a case against a prominent University. As of last week over 400 colleges had announced some sort of vaccine mandate for their new and returning students in the Fall, and unfortunately we can’t sue every single college. An important aspect is that we need more people to speak out because judges are human beings and they need to know they have popular support on their side. A recent protest at Rutgers by parents and students got national attention: https://njstandsup.org/press-release and needs to be repeated in every state and every college. Forced vaccination is not only unethical, it violates the tenets fundamental to a free society and it will take all of our unified efforts to stop it.

    I work for a publicly traded construction firm here in LA and they are trying the same thing, making the vaccine a condition of employment. I hope the Teachers union wins this one and sends a clear message to all the tyrants out there we the people have rights!

    This is NOT a vaccine, it does not meet the legal definition because it does not prevent the disease nor does it prevent transmission of the disease! It is NOT COMMON SENSE to take a jab which does not prevent the disease when there are other therapeutic treatments! In addition to that, there is no liability which makes the likelihood of injury greater since they know they are immune from liability. Last of all, but not least of all, the mortality rate is very low in most age groups, much like the flu, therefore mass vaccination seems unnecessary exaggeration for purposes which are not being spoken. The situation with this virus is very questionalble and needs further investigation.

    I am a school counselor with LAUSD and I am so thankful that you are taking this on for us!! I have expressed my concern over so much since this all started, and it has gotten me nowhere but asked not to return to campus, and blocked by our union on social media.

    The only way out of this mess is banning together in large numbers and rejecting ALL medical mandates for any student or staff member. Medical autonomy is a basic human right that no government has the right to infringe upon for ANY reason EVER! The fact that they are using these vaccines to restrict our mobility and keep our employment is alarming and we cannot not stand for it!
